Parcel Regulations
The relationship between the owner of the goods and that
of Sunshine Pack & Ship shall be one of bailment, whereas
the title of the goods remains with the owner, shipper and/or
consignee, whoever is in control until such time as title
is passed. Sunshine Pack & Ship shall be charged
only with the care, custody and control of the goods, and
the rules and regulations set forth herein, and those in the
transportation carriers’ tariffs, shall govern the
transportation and storage thereof. The following shall
apply for all parcels in transit, originating at the Sunshine
Pack & Ship location:
- Unless a higher value is declared in writing and appears on
customers receipt, in advance of shipping, each parcel shall
be deemed to have a maximum value of $100 if carried by UPS,
FedEx or DHL, and no value if carried by USPS or any other carrier. Letter
envelopes sent by UPS, FedEx or DHL shall have a maximum declared
value of $100 in all cases. The entry of a COD amount or
Customs Value is NOT a declaration of value.
- Any item received for packing and/or shipping may be opened
by Sunshine Pack & Ship or carrier for inspection.
- Articles of a hazardous nature, dangerous goods of any type
or any other commodity whose transport is prohibited by the
carrier or any governmental authority shall not be accepted.
- Customer accepts full responsibility for damage to any article
packed by customer, and Sunshine Pack & Ship shall have
no liability whatsoever. Customer is responsible for determining
proper specifications for the contents prior to packing.
- In no event shall Sunshine Pack & Ship be liable for any
consequential, incidental or special damages which may arise
from loss or damage, or non-delivery or delayed delivery. This
limitation shall include, and not be limited to, damages for
loss of profit or income.
- Customer warrants that the address label is complete and accurate,
and agrees to hold Sunshine Pack & Ship harmless for packages
that are lost or mis-delivered because of an inaccurate address. If
carrier is required to correct the address or deliver to another
address, customer agrees to pay reasonable fees associated with
this additional service. Address correction charges will
also apply to any UPS, FedEx or DHL shipment sent to a P.O. Box
or Rural Route Box deemed undeliverable by the carrier. Address
corrections may result in delivery delays that neither Sunshine
Pack & Ship nor the carrier can be responsible for.
In addition, FedEx will require additional shipping charges
be paid to reroute or dispose of undeliverable shipments unless
the undeliverable shipment is the result of a service failure. Undeliverable
shipments may be returned via FedEx Express Saver (3 business
day service) at the Customer's expense. Sunshine Pack & Ship
reserves the right to hold any return shipment until Customer
reimburses Sunshine Pack & Ship for the return shipment
fees.
- Customer is responsible for furnishing adequate information
to permit Sunshine Pack & Ship and the carrier to investigate
claims for loss or damage. Such information shall include
consignee's name, address, telephone number, and email address,
date of shipment, parcel contents, value, and package ID number.
- Before requesting tracing of an undelivered package, customer
must verify non-receipt with the consignee and wait a reasonable
period of time which shall be determined by Sunshine Pack & Ship. All
tracing and tracking is to be done by Sunshine Pack & Ship
personnel.
- In the event of parcel damage, Sunshine Pack & Ship will
process a claim if all of the following steps are taken by either
the customer or the consignee:
a. Notation of obvious damage on the carrier's delivery document;
b. Retention of all cartons and packing materials;
c. Entire shipment must be held at the delivery point, without further transport or moving;
d. Prompt notification to Sunshine Pack & Ship on the discovery of damage,
and no later than forty-eight (48) hours after receipt of shipment; and
e. Cooperation with Sunshine Pack & Ship's instructions for processing the claim.
- In order to establish actual cash value in the event of damage
or loss, customer is responsible for furnishing Sunshine Pack & Ship
with an original invoice, receipt or appraisal which is not more
than one year old. The amount declared by customer at the
time of shipment is not an acceptable proof of value.
- In the event of loss or damage of any article, Sunshine Pack & Ship's
liability shall be limited to the lesser of (a) the actual cash
value of the article or (b) the amount necessary to repair or
replace the article, or (c) the amount declared by the customer,
in writing, at the time of shipment.
- Carriers may deny any claim for physical damage or mechanical
derangement caused by shock or vibration to items by which an
inherent vise of the item makes it not suitable to the shipping
environment. Examples of these items include sheet glass,
light bulbs, electronics, handmade porcelain and ceramics, etc. Customers
shall assume strict liability, and Sunshine Pack & Ship shall
be released of all liability in these cases.
- Customer agrees that once a claim for loss or damage has been
paid, customer waives all rights to file further claims on that
particular shipment.
- In the case of items shipped via United States Postal Service,
customer is fully aware that claims or tracing is impossible
without the purchase of special services at the time of shipment.
- Sunshine Pack & Ship may attempt to notify customer of
undeliverable packages by telephone before sending written notification. Undeliverable
packages must be collected by customer or reshipped at an additional
charge within 30 days of written notification. Failure
by the customer to provide disposition instructions and pay any
applicable fees after the elapse of 30 days shall be deemed an
abandonment of the shipment, and a waiver of all rights of title
to the goods. Sunshine Pack & Ship shall dispose of
said shipment as it sees fit, without further liability to customer.
- Delivery times and dates are estimates based on information
provided by carrier and are subject to change without notice. Sunshine
Pack & Ship will not be liable for failure of carrier to
affect a timely delivery. Only shipping charges are refundable
on guaranteed shipments. Sunshine Pack & Ship shall
not be liable should carrier refuse refunds.
- Sunshine Pack & Ship’s policy is to instruct the
carriers to collect payment from receivers in certified funds
or postal money orders only, and shall not be liable for carrier’s
failure to collect COD monies as instructed. Furthermore,
if payments are received by personal checks or other instruments,
and these are returned due to insufficient funds, being counterfeit
or for any other reason, Sunshine Pack & Ship shall be released
from the responsibility of collection of said funds, or to guarantee
payment in these cases.
- Every Sunshine Pack & Ship centers accepts drop-offs,
acting as a carrier drop box, as a sole purpose of being a facilitator
for the convenience to the customers of the carrier only. All
inquiries for assistance should be direct to the payer of the
shipping charges, as the Sunshine Pack & Ship center accepting
the drop-off shall have no liability to any party whatsoever
for any lost, damaged or delayed shipments.
- Sunshine Pack & Ship reserves the right to add, revise, or
subtract from these terms and conditions at any time without notice.
